Background

NYACP, in collaboration with Boston University School of Medicine, is providing this course in response to NYS Public Health Law Section 3309-A, enacted in 2016, which requires professionals licensed under Title 8 of the NYS Education Law with a valid DEA number and every medical resident prescribing under a hospital or facility DEA number to complete a 3-hour training course covering the following specific elements:

  1. State and Federal laws on the prescribing of controlled substances
  2. Pain Management
  3. Appropriate Prescribing
  4. Managing Acute Pain
  5. Palliative Medicine
  6. Prevention/Screening/Signs of Addiction
  7. Responses to Abuse and Addiction
  8. End of Life Care

This course is designed in three modules. The first two modules are the highly acclaimed Boston University School of Medicine Safer/Competent Opioid Prescribing Education (SCOPE of Pain) Course. The 3rd module contains the newly updated final hour of elements required by the New York State law not covered in the SCOPE course.

Important Navigation Tip

This educational activity is easy to navigate.  If you choose to exit the course with the intent to return and complete it at a later time, you must NOTE your position in the course prior to exiting (by slide number or recorded time). Upon resuming the course, it will automatically DEFAULT to the beginning of course. You can then use the navigation bar below the power point to find exactly where you left off within the module. When returning to the course go to the Scope of Pain page and log back in using the username (your email address ) and the password you created at  initial registration. If you forgot your password, click forgot password and you will be emailed a new one.

Certificates

Upon completion, you should print 2 separate certificates.  One certificate is for the 2-hours of SCOPE and one certificate for the additional New York specific content. These certificates should be retained in your files.

Attestation

For compliance purposes, prescribers must file the self-attestation after completing the course. Your attestation can be submitted online through your Health Commerce System (HCS) account.

Prescribers that do not have access to a computer can request a paper attestation form by calling the Bureau of Narcotic Enforcement (BNE) toll-free at 1-866-529-1890. They may then complete the form and return it by mail to the address provided.

For auditing purposes, you should keep your course completion documentation for a minimum of six years from the date of the attestation deadline. Documentation must include the name of the course provider, name of the course, location it occurred, date it occurred, and number of hours completed.

                           Waivers and Exemptions

In certain very limited circumstances, the New York State Department of Health may grant an exemption to the required course work or training to an individual prescriber who clearly demonstrates to the department that there is no need to complete such training. Exemptions will be granted only in very limited circumstances, and not solely on the basis of economic hardship, technological limitations, prescribing volume, practice area, specialty, or board certification. Prescribers may request an exemption by utilizing the Health Commerce System.
